The Fair Work Amendment (Secure Jobs Better Pay) Act 2022 amended the Fair Work Act 2009 (Cth) to limit the use of employment contracts which terminate at the end of an identifiable period. The provisions commence 6 December 2023.

The Australian Government has recently registered the Fair Work Amendment (Fixed Term Contracts) Regulations 2023 which:

  • prescribe that the limitations on fixed term contracts do not apply in relation to
    certain types of employees who enter into contracts on or after 6 December
    2023 and before 1 July 2024;
  • prescribe exceptions for employees whose positions are funded by certain non-government philanthropic arrangements; and
  • provide guidance on the calculation and application of the high income
    threshold.
