• The model WHS Regulations have been updated to:
- implement the ban on engineered stone benchtops, slabs and panels with effect from 1 July 2024, with transitional arrangements to 31 December 2024 in some jurisdictions;
- introduce new requirements to ensure that all crystalline silica processes are
controlled with effect from 1 September 2024; and
- establish additional obligations for high-risk crystalline silica processes.
• Guidance material associated with the ban has also been published.
• Guidance material to support the new silica regulations is currently under development
and expected to be published by early August 2024.
• It is now up to individual jurisdictions to adopt the laws in their jurisdiction.
• It is important to note that Victoria and the ACT already have regulations in place that address silica, and it is not clear whether they will make any amendments to align with the model WHS regulations.
