A key reform of the Anti-Discrimination and Human Rights Legislation Amendment (Respect at Work) Act 2022 was the introduction of a positive duty in the Sex Discrimination Act 1984 (SD Act).
The positive duty requires employers and PCBUs to take reasonable and proportionate measures to eliminate, as far as possible, sex discrimination, sexual harassment, sex-based harassment, behaviours that create a hostile workplace environment on the ground of sex and related acts of victimisation occurring in a work context or in connection with work.

Fair Work Legislation Amendment (Closing Loopholes) Act 2023 The Fair Work Legislation Amendment (Closing Loopholes) Bill 2023 was introduced to Parliament by the Government on 4 September 2023 and proposes significant changes to the Fair Work Act. The Closing Loopholes Bill has been split in two. The elements of the Bill that the Senate agreed to were retained in a pared down version of the Closing Loopholes Bill which was passed by the Parliament on 7 December 2023 and received Royal Assent on 14 December 2023.
