It is essential that investigations into complaints of bullying and harassment and alleged misconduct are sound, defensible and procedurally fair. A workplace investigation can be subject to scrutiny in a range of jurisdictions, including unfair dismissal, general protections, workplace bullying and anti-discrimination.

A flawed investigation could result in a finding of unfair dismissal, even if there was a valid reason for ending that person's employment, or liability for the business.

This full day workshop balances legal theory and practical skills to equip managers and HR practitioners to conduct effective workplace investigations. Upon completion participants will be able to:

  • Determine when an investigation is appropriate and/or required
  • Define the role and responsibilities of an investigator
  • Develop an investigation plan and terms of reference
  • Apply principles of procedural fairness and natural justice throughout the process
  • Conduct interviews
  • Document and record the evidence collected during an investigation
  • Evaluate evidence and report on the investigation
